# How to add a long-term rental listing for an attic used as storage?

You have an attic or a room in the loft that stands empty, and you want to rent it out long-term to someone who needs space for their things. Before you add a listing, check one thing. Not every attic can lawfully be used for storage.

Below we explain how to check this, what to prepare, how to add a listing on Maszbox.pl step by step and what to remember about the agreement.

## Before you start: can your attic be rented out for storage?

### Usable or non-usable attic

Fire regulations (§ 4(1) points 12 and 13 of the Regulation of the Minister of the Interior and Administration of 7 June 2010 on the fire protection of buildings) prohibit:

- storing flammable materials in non-usable lofts and attics,
- keeping flammable gas cylinders there, whether full, partly full or empty.

Flammable materials also include ordinary things: cardboard boxes, clothes, books, wooden furniture. The Supreme Administrative Court (judgment of 30.05.2016, II OSK 1096/16) upheld an order to remove cardboard boxes, wooden crates and furniture from an attic. The court also explained that whether an attic is “non-usable” depends on its legal and technical status. Whether someone actually uses it does not matter.

In practice:

- **A non-usable attic** (an ordinary loft not adapted for use) is not suitable for lawfully renting out to store typical things. The fire service may order the things to be removed, and breaching fire regulations is punishable by a fine. The ban applies to buildings, including houses.
- **An attic adapted for use**, for example separate utility rooms or storage units in the loft provided for in the building documentation, can be rented out just like a storage unit.

You can check the status of the attic in the building documentation or with the manager of the housing community or cooperative. In a house, check it in the building design. If you are not sure, ask the manager or a fire safety specialist before you add a listing.

### Whose space is it

In a block of flats, the attic is usually a common part of the building. In that case the housing community or cooperative decides on renting it out, not an individual resident. It is different when a room in the attic is appurtenant to your flat or when it is the attic in your own house. The same rules apply to rooms in the attic.

### What to prepare

- **Dimensions:** the floor area, the height at the highest and the lowest point (sloping ceilings), the width of the door or hatch.
- **Entrance:** stairs, a ladder or a hatch. Large items may not fit through a narrow entrance.
- **Temperature and damp:** an uninsulated attic gets very hot in summer and cold in winter. Mention this, because it matters for electronics, photos or wooden furniture.
- **Load:** if you do not know how much the attic floor can hold, do not promise space for heavy items.

### Step 1. Sign in or create an account

Sign in to your account, or create a new one if you do not have one yet. Then click the “Add listing” button.

### Step 2. Fill in the location

Enter the exact location:

- city,
- street,
- building number,
- district (if it was not filled in automatically).

### Step 3. Enter the listing title

Enter a short title with the floor area and the location, for example: **Utility room in the attic 12 m² - Kraków, Podgórze**.

### Step 4. Fill in the listing description

In the description, give everything a tenant would ask about. You can use this template and fill in the fields in brackets:

[Utility room / storage unit] in the attic for long-term rent at [street] in [city], [name] district.

- attic adapted for storing things (in line with the building documentation)
- floor area: [X] m², height: [X-Y] m (sloping ceilings), entrance width: [X] cm
- entrance: [stairs / ladder / hatch], floor: [X], [with a lift / without a lift]
- [insulated / uninsulated], [with lighting], locked with [a padlock / a lock]
- access: [24/7 / hours X-Y], key to the building: [yes / no]
- no fire-hazardous materials (fuel, gas cylinders, solvents, fireworks)
- available from: [date]

Only include the first line of the template if the attic really is adapted for storage. Only describe what is true.

### Step 5. Add photos

Add photos of the attic. The maximum size of one photo after compression is 5 MB. Allowed file formats are:

- jpeg,
- png,
- webp.

Take photos with the light on. Show the interior, the sloping ceilings, the entrance and the door with the lock. Do not photograph your neighbours' belongings or other people's rooms. Only add current photos of your own attic.

### Step 6. Pick the listing type

Pick the listing type: **Rent**.

### Step 7. Pick the listing category

Pick the category: **Attic**.

### Step 8. Pick the rental period

Pick the rental period: **Long-term**. For a long-term rental you do not set availability dates.

### Step 9. Pick the condition

Set the condition of the attic, for example **Partially finished**. Pick the option that matches reality and what the photos show.

### Step 10. Enter the floor area

Give the floor area in square metres (m²). Describe the height and the sloping ceilings in the listing description (step 4), because with an attic the floor area alone does not tell you how many things will fit.

### Step 11. Pick the floor

Set the floor, for example **3rd floor**.

### Step 12. Pick the access

Pick the type of access, for example **Access during limited hours**. Pick the option that matches the building rules and the way the keys are handed over.

### Step 13. Tick the extra options

Tick the security and usage options that are really available.

### Step 14. Enter the price

Enter the gross price for one month of rent. Gross means the full amount the tenant will pay, with no hidden extra charges. If you take a deposit, say so in the listing description.

### Step 15. Accept the consents and declarations

Read and accept the required consents and declarations.

### Step 16. Add the listing

## After adding the listing: the agreement and the storage rules

You sign the agreement directly with the tenant. Maszbox.pl is a listings service and is not a party to that agreement. For a long-term rental, put the agreement in writing. Include in it:

- the details of the parties and an exact description of the room,
- the rent, the payment date and the deposit,
- the rental period and the notice rules,
- a ban on storing fire-hazardous materials and gas cylinders,
- the access rules, the number of keys and the obligation to follow the building rules,
- the deadline for clearing the room after the rental ends.

Give the tenant a key so that they can put in and take out their things themselves. If the tenant does not collect their things after the rental ends, do not throw them away or sell them on your own. Give them a deadline for collecting them in writing, and if they do not respond, ask a lawyer.

If you rent out as a business, the tenant is a private person and you sign the agreement online, consumer rights rules also apply to you.

### Tax on renting out an attic

The rent is revenue on which you pay tax. For a private rental this is a flat-rate tax: 8.5% of revenue up to PLN 100,000 a year and 12.5% on the excess. If you rent out several rooms in an organised way, ask an accountant whether this is already a business activity.

## Common questions

### Can cardboard boxes and furniture be stored in an attic?

Not in a non-usable attic. Fire regulations prohibit storing flammable materials there, and cardboard boxes, clothes and wooden furniture are among them. They can be stored in a room in the attic that is adapted for use, for example in a separate storage unit provided for in the building documentation.

### Can I rent out an attic that is a common part of the building?

Not on your own. The housing community or cooperative decides on common parts. Ask the manager before you add a listing.

### Do you pay tax on renting out an attic?

Yes. For a private rental you pay a flat-rate tax of 8.5% of revenue up to PLN 100,000 a year and 12.5% on the excess. You do not have to set up a business.
