# How to add a sale listing for a plot?

Below you will find a step by step guide to adding a plot sale listing on Maszbox.pl. Before you start, check what kind of plot you are selling. Its zoning and land type decide what you can write in the listing and who can buy it.

## Before you start: check what kind of plot you are selling

### Plot zoning

You can call a plot a building plot only if this follows from the local zoning plan (MPZP) or from a zoning decision (decyzja o warunkach zabudowy) issued for it. If there is neither a plan nor a decision, do not write “building plot”. Describe the actual status instead, for example: “no local zoning plan, a zoning decision can be applied for”.

You can check the zoning at the municipal office (urząd gminy), in the extract and map from the local zoning plan, or in the municipality's geoportal.

### Agricultural and forest plots

Under the Polish Act on shaping the agricultural system, an agricultural plot is one that the local zoning plan does not designate entirely for non-agricultural purposes. Who can buy it depends on the area of agricultural land:

| Plot | Who can buy it and what to watch out for |
| --- | --- |
| Agricultural, under 0.3 ha of agricultural land | Anyone. The Act on shaping the agricultural system does not apply. |
| Agricultural, from 0.3 to 1 ha | As a rule anyone, but the National Support Centre for Agriculture (KOWR) or the plot's leaseholder may have a pre-emption right. |
| Agricultural, 1 ha or more | A buyer who is not an individual farmer usually needs KOWR's consent (there are exceptions, for example for close relatives). |
| Forest: forest in the land register, land designated for afforestation in the local zoning plan or in a zoning decision, land covered by a simplified forest management plan | The State Forests (Lasy Państwowe) have a pre-emption right, apart from exceptions such as a sale to a spouse or close family. |

In some cases the municipality also has a pre-emption right. The notary will check this before the sale.

### What to prepare

- the land and mortgage register number (księga wieczysta),
- the cadastral plot number and precinct (obręb),
- an extract from the land register (county office),
- an extract and map from the local zoning plan or the zoning decision (municipality), if there is one,
- information about access to a public road: direct or through an easement,
- information about utilities: electricity, water, sewage, gas (at the plot or in the road),
- the dimensions and shape of the plot.

## How to add the listing step by step

### Step 1. Sign in or create an account

Sign in to your account or create a new one if you do not have it yet. Then click the “Add listing” button.

### Step 2. Fill in the location

Enter the location of the plot:

- city, town or village,
- street,
- building number (if the plot has no address number, fill in the field following the form's hints),
- district (if it was not filled in automatically).

Give the cadastral plot number and precinct in the listing description (step 4).

### Step 3. Enter the listing title

Write a title with the zoning, area and location, for example: **1,000 m² plot with a zoning decision, electricity at the plot - Nowa Wieś near Rzeszów**.

### Step 4. Fill in the listing description

You can use this template and fill in the fields in brackets:

Plot for sale in [town], [street] street, cadastral plot number [X], precinct [name].

- area: [X] m², dimensions: [X] × [X] m, shape: [rectangular / irregular]
- zoning: [local zoning plan: single-family housing / zoning decision dated … / no plan and no zoning decision / agricultural land]
- access: [paved public road / dirt road / right-of-way easement]
- utilities: [electricity, water, sewage, gas], [at the plot / in the road / none]
- land and mortgage register: [number available on request / number]
- sale before a notary

Describe only what is true and follows from the documents.

### Step 5. Add photos

Add photos of the plot. The maximum size of one photo after compression is 5 MB. Allowed file formats:

- jpeg,
- png,
- webp.

Show the plot from several sides, the access road and the boundary markers if they are visible. Take the photos in daylight. Do not show people or the neighbours' private properties up close.

### Step 6. Pick the listing type

Pick the listing type: **Sale**.

### Step 7. Pick the listing category

Pick the category: **Plot**.

### Step 8. Pick the plot type

Pick the plot type that matches the documents. Choose a building plot only if this follows from the local zoning plan or from a zoning decision. Otherwise pick the type that matches the legal status, for example agricultural or recreational.

### Step 9. Enter the area

Enter the plot area in square metres (m²), as stated in the land and mortgage register or the land register extract.

### Step 10. Tick the extra options

Tick only the options that really apply to the plot, for example electricity, water, sewage or car access.

### Step 11. Enter the price

Enter the gross sale price, that is the amount the buyer will pay. If you are selling as a private person, this is your final price. The price does not include the civil law transactions tax (PCC) or notary fees. ### Step 12. Accept the consents and declarations

Read and accept the required consents and declarations.

### Step 13. Add the listing

Once all the details are filled in, click the button to add the listing. Your listing will appear in the plots category. You can find the general rules for adding listings on the [how to add a listing](https://maszbox.pl/en/jak-dodac-ogloszenie.md) page.

## After adding the listing: notary, pre-emption right and taxes

You sign the sale agreement directly with the buyer. Maszbox.pl is a listings service and is not a party to that agreement.

- **Notarial deed.** A plot must be sold before a notary. An agreement signed without a notarial deed is invalid.
- **Pre-emption right.** If it belongs to KOWR, a leaseholder, the State Forests or the municipality, the notary first draws up a conditional agreement and notifies the entitled party. It usually has one month to decide. Only then is the agreement transferring ownership signed.
- **PCC.** The civil law transactions tax is 2% of the market value. The buyer pays it and the notary collects it.
- **PIT.** If you sell within 5 years, counted from the end of the year in which you bought the plot, you pay 19% tax on the income and file a PIT-39 return by 30 April of the following year. An exemption is possible in some situations, so ask an accountant about it.
- **VAT.** If you divide land into many plots and sell them like an investor, for example by bringing in utilities, marking out roads and advertising, the tax office may treat this as a business activity and charge VAT. In that situation ask a tax adviser.

## Questions about selling a plot

### When can I say that a plot is a building plot?

When building use follows from the local zoning plan or from a zoning decision issued for the plot. Without these documents such a description may mislead buyers.

### Can someone who is not a farmer buy an agricultural plot?

Anyone can buy a plot with less than 0.3 ha of agricultural land. As a rule, the same goes for a plot from 0.3 to 1 ha, but KOWR or a leaseholder may have a pre-emption right. For a plot of 1 ha or more, a buyer who is not an individual farmer usually needs KOWR's consent.

### Do you pay tax when selling a plot?

The buyer pays 2% PCC. The seller pays 19% PIT on the income if they sell within 5 years, counted from the end of the year of purchase. When many plots are sold after dividing land, VAT may also apply.
